Court Order Ends Cantideck and Conquip Industrial challenge to Xena Systems Rolling Platform Patent

In April 2011, Xena Systems Limited issued court proceedings against Cantideck and Conquip Industrial for infringing Xena's European Patent for their rolling platform. On 23 June 2011, Cantideck and Conquip Industrial decided not to file a defence and submitted to judgment in respect of their infringement of the Patent. Cantideck and Conquip Industrial had been dealing in rolling platforms covered by Xena's patent without a licence.

The court order secured by Xena, requires Cantideck and Conquip Industrial not to infringe the patent in the future and hand over any infringing products they currently hold to Xena. In addition, Cantideck and Conquip Industrial have agreed to pay compensation to Xena Systems and have contributed to their legal costs. The level of compensation has yet to be determined.

In 2004, Xena Systems developed the patent, which covers a unique system whereby rolling platforms retract fully into the building whilst increasing the space for loading behind the platform when extended. The patented system allows the full loading area of each platform to be utilised when they are used stacked above each other. This dramatically improves efficiency and allows the building to be closed out earlier, shortening the time to stage payments for the contractor.

Prior to the English court proceedings, Cantideck had challenged the validity of Xena's European patent but without success.
